months. undetected for several months. denver investigates why it took more than 8 months for charges to be filed, following the brother's confession. that's your brother's name on that criminal complaint. >> it's heartbreaking. i can't say anymore than that. it's absolutely heartbreaking. >> reporter: the complaint reads the people of colorado vs. dustin nester. >> it's very disappointing and heartbreaking to say the least. why not expect this from any of my employees. brother or not. they're treated the same, i'm appalled. >> reporter: his brother worked inside the sheriff's office. charges include two counts of embezzlement of public property. >> from our stand point, this is serious.

investigation, the district made the decision to file the charges. >> nobody is above the law. >> reporter: the sheriff's brother admitted to breaking into the sheriff's evidence room, there the complaint says he signed a dirty harry type weapon. the complaint says zane nester thought the revolver might be worth some money. he hoped to sell it for about $1,400. >> you are concerned the impact this might have on the integrity of the office? >> absolutely. >> reporter: concerned because the criminal complaint also said the sheriff's brother was able to gain access to the evidence room, because it was not properly secured. and less than a week after his initial confreaks, the criminal complaint said zane nester

weapon from the room. the court document also says the sheriff's brother stole the second gun five days after stealing the revolver. this time he accessed the evidence locker by taking a master key. >> what happens here, is the trust about inside your office. >> we've taken substantial steps to increase security, key control from our evidence locker, and obviously that was the biggest issue. >> reporter: also questions about the delays in the investigation. records show zane nester admitted to stealing and trying to sell two guns from the sheriff's evidence locker in april of last year. charges were not filed for more than 8 months. the court document says december 23, charges officially filed two days after a phone call by denver 7 investigates.

took so long for the charges to be filed. >> i think it's a fair question. >> reporter: district attorney brockler says part of it can be linked to a forensic computer analysis. >> our call had nothing to do with it. >> if i got a call from tony kovaleski that said what's the status of this case, would that light a fire under me to say, what's going on? might it have taken another week or two to get it filed, okay. but i don't think it was lang wishing on your desk, waiting for a call. >> no special treatment for the brother of a sheriff. >> not a chance, not in this jurisdiction, no way. >> reporter: denver 7 also asked questions of zane nester following a repeat court appearance in linken county. >> do you think the people of lincoln county deserve a comment? >> do you think that he has remorse for what happened? >> i have no doubt. i have not talked to him a lot about the case.

so i'm going to talk to him. i have no doubt in my mind he's remorseful. >> reporter: a couple notes to leave you with tonight. dustin nester's trial should begin later this yyar. the sheriff says he has implemented several changes to prevent it from happening in the future. dustin nester resigned his position in the middle of that investigation. this is also troubling. we have learned that it took more than 100 days to realize that those guns werr missing from the evidence locker. >> wow. incredible. shocking, thank you, tony. terrifying moments for a long month woman. police want to find him. this is richard mon. earlier tonight, police found his truck near mead high school, but no sign of mon. this woman is accused of killing two motorcyclists near

athina munoz's car hit two motorcycles, killing one of the riders and one of the passengers. we looked into munoz's past, and back in 2011 she killed two men who broke into her home when she was growing medical he never faced any charges under that case, because it fell under the make my day law. who would do this? taking all the cash from a group of girl scouts out selling cookies. it happened this weekend in aurora. molly hendrickson is live outside. something pretty special for these scouts. >> reporter: when the officers showed up at this king supers they felt compelled to help. not only did they donate their own hard earned cash, they also got their fellow officers to follow suit. when you're a cop, sometimes it's calls you least expect that leave the biggest impact. >> that's rye i got into work

techniial side of awards, really sort of recognizes that the kind of work that went into a rather underrated movie, if you're looking at it artistically. it's kind of a surprise, because the oscars really are about emotion more than artistic merit. it was a great surprise to see them win those awards. >> reporter: not your favorite. >> not my particular favorite -`movie, but the kind of craftsmanship they put into the movie was really above par. >> reporter: let's talk about leo. a big night for him. he's been nominated multiple times, and he finally got that statue. >> you can imagine that emotion he finally felt when he got to go up there, this whole season, that kind of momentum leading him forward to that moment. of course, he used that moment to talk about issues that were important to him, he felt were reflected in the work and the kind of thing that artists do in those moments. >> reporter: what was your favorite moment of the evening? >> i really loved seeing lady gaga take advantage of that kind of platform to not only acknowledge that she was a surviver of sexual assault, but

new at 10:00, we all know our college students in colorado are pretty smart, and creating amazing things both inside the classroom, and after graduation. >> some students are finding out the hard way, what they property. mark, you found some students trying to save lives with their creation. >> reporter: these are students studying at cu denver. this is a rescue helicopter. when they lower that rope, a basket, or rescuer, here's a piece of rescue cable they use. here's the swing. they're devicing a device that goes across the top. what it does is stop, the rope swing, making everything much more safe. it's one of the most terrifying moments for me rescue crew member. not having control of the cable that's lowering them. >> they tried lowering a rescuer and the basket to try
